Obama Nominee “on ICE” as After Raids of Immigrant Workers

Stephanie Rose, the president’s nominee for U.S. Attorney in northern Iowa, has seen her approval process delayed amid questions about her role in a series of workplace raids targeting undocumented workers. As in Reno and Las Vegas, Nevada a year before, Bush Administration officials led a raid on a meatpacking plant in Iowa in May 2008 that led to criminal charges against hundreds of illegal immigrants working at the facility who lacked work visas or other authorization.
Rose, then an assistant prosecutor in the U.S. Attorney’s office, drew attention when she charged the immigrants with felony identity theft charges for the false use of Social Security numbers and other identification. Though she is favored by Obama, Iowa Senator Tom Harkin, and dozens of other attorneys (even some of those whose clients she prosecuted), her complicity in what is seen as an “excessively harsh” prosecution has led some to call for denial of her nomination, as the New York Times explains.
After immigration lawyers for the unauthorized workers appealed their case in Immigration Court, the Supreme Court ruled a year after the raids that identity theft charges are not appropriate for prosecuting illegal aliens in such circumstances. Despite Rose’s unquestioned competence as an attorney, some feel this rebuke of her tactics blights her record as a fair prosecutor.
