Obama to Require Businesses to use E-Verify

According to the Secretary of Homeland Security Janet Napolitano the Obama administration will soon require that businesses that win federal contracts must use an electronic verification system to ensure that employees have legal immigration status to work in the United States. The system, known as “E-Verify” will allow federal contractors to identify whether or not the contractor is hiring illegal or undocumented workers.

In addition, the Obama administration will eliminate the Bush administration policy the “no-match rule” which sanctioned employers for retaining employment for those whose Social Security numbers did not match Social Security records. This comes at long last following challenges in federal court by businesses and immigrant advocates who argued that errors in record keeping by the SSA had led to thousands of legal workers losing their jobs.

The move to require E-Verify in many businesses marks a first step for the administration to keep pace with immigration enforcement while they decide whether to perform an overhaul of the system that would legalize millions of illegal workers living and working in the United States.
