DHS Extends TPS to Haitians Currently in U.S.

In the wake of the January 12, 2010 earthquake that struck Port au Prince, Haiti, the international community has come together in inspiring fashion to attempt to stem the suffering and help those in need. We at Family Visa & Immigration Services, like many others around the world, are hoping for the best and encouraging all who can to donate money to the relief effort. The group InterAction offers a list of many organizations that are collecting donations.

For its part, the U.S. Department of Homeland Security has extended Temporary Protective Status (TPS) to all foreign nationals from Haiti residing in the United States as of the day of the tragedy.

** NOTE: Neither TPS nor any other immigration protection is currently available to those displaced by the tragic earthquake. Haitians who were not already in the United States when the earthquake struck are NOT eligible for relief and may be repatriated if they attempt to enter the United States. **

TPS, as the name implies, is designed to protect certain foreign nationals for a limited time. In this case, Haitians currently residing in the United States have been given the opportunity to apply for TPS and thereby gain lawful immigration status for the next 18 months. Once protected under TPS, these immigrants can apply for work permits and travel privileges, in addition to pursuing Adjustment of Status or Cancellation of Removal.
